Man arrested and charged w/felony over $1 drink @ mcdonalds

what an idiot in not paying when he got caught and even more of an idiot for refusing to leave when asked to leave. I assume that refusal was the reason why the authorities were called.

Since this guy has prior theft convictions I don't think it's fair to say that he was given the felony charge ONLY from stealing that $1 drink. Had the person had a clean record and then got a felony I could see the felony charge being inappropriate. Also, we don't know what his past record had him stealing. Was he on probation from those past crimes?
