I would leave a neutral if I get the card undamaged. That is just me. Some people try to make money off shipping.

i retract that statement, who am I to call someone sketchy...as far as me being sketchy is concerned, maybe its true, maybe i am...i described the card, gave both front and back scans, and agreed to sell outside ebay because i could give you a cheaper price, since you were so willing to call me out and call me a scammer and call my (your) card a fake (even though it plain to see i had no idea what a 52 topps even looks like), all before the card was even processed through my local PO, I figured i would ignore you and let paypal handle it. so whatever they say is what im going by....sorry for the hijack but i was called out as being hypocritical for what i had previously posted...and heck maybe he's right, but i wasnt out to scam, i was out to feed my collecting addiction with a good deal for both of us..........

That has nothing to do with being shady. I am not saying that I am going to do it but if I get the card undamaged I would leave a neutral. It is only $1.30. It is not a big deal as to probably mess up his feedback score.

The point is if the card arrived undamaged and you are happy that should be fine. Sure your losing $1.30 on the insurance fee. But I don't think that's enough money to lose sleep on. If the seller has %100 positive feedback I don't think you should leave negative and mess it up. However, if its something like %97 then another one won't make a difference.
BTW people that say don't leave negative are not shady. Things happen and nobody knows the truth. We are not mind readers.

OK - Peoplare severely MISSING THE POINT.
$1.30 isn't much money to lose - we all get that.
Maybe the seller made an honest mistake forgetting the insurance - we all get that.
Here is the POINT - The buyer contacted the seller, the seller was shown the mistaken, and the seller has either chosen to STEAL his money or chosen not to respond to his email.
If the seller actually refunded the money or at least replied to his email apologizing then you can certainly leave a positive or a neutral - the seller, based on what the OP has said, has done neither. So right now all he has done is steal, regardless of amount, money from the buyer.
Not sure when the seller was contacted - but if he had gone 5-7 days without providing a refund, apology, or at least replying to the email then he ABSOLUTELY deserves a negative.
Amount doesn't matter. Mistakes happen. Not replying to an email with an apology or refund is flat out stealing.

If people looked at the facts instead of taking one side or the other you would find some things out.
Ebay does not allow for seperate charges for insurance because as everywhere else i the world it is the job of the seller to make sure that the buyer receives what they pay for. (If this had been pointed out to Ebay the auction might have been cancelled). You CAN roll insurance into your shipping and handling charges though.
A simple look at the auction under the "Shipping and Payments" section it clearly states that the Shipping and Handling is $5.30 and that insruance is "Included in the S&H"
Therefore you should have only paid $5.30 to get the item delivered to you. If seller refuses to refund any charges over $5.30 than a negative in warranted.
You can also file mail fraud charges against the seller if you wish as he did not provide the level of service you paid for.
Seller is just tyring to recoup some fee $$ which is also prohibited.

You're right, jlzinck. I've overlooked this by mistake at it's quite clear that an inclusion of the insurance fee does not imply a separate fee relative to the shipping and handling. The insurance fee is included in the overall S&H yet I was charged this additional fee. Conscious dishonesty is definitely unwarranted in my mind and I would in no way have any problem placing a negative. At this moment the seller has yet to contact me since this thread's creation. I will attempt once more as I believe at this moment the principles (legal ones at that) justifies the negative.

I wouldn't leave a negative if the card arrived in good condition.
Say I buy a card for $2.50, + $2.50 shipping. I see it as paying $5 for the card.
Its kind of the idea that I'm paying for the "overall," not a certain amount for the card and a certain amount for shipping. If I'm happy with the price, I would just leave a positive and send him a separate message. There's no way to know if the seller does the same thing with other items, people just assume.
But that's just my perspective.
