I get them not being happy about the name similarities, but I'd bet there are lots of businesses around that are similarly named to Ben & Jerry's. It's two names but together. That's not all that original. I'd assume there were some companies around called that before they came onto the scene.

I'm also confused about the issue with them parodying Boston Creme Pie and Peanut Butter Cup. How exactly did Ben and Jerry come up with those terms? They are foods that were around well before they made ice cream to taste like them.

The funny thing is, most of the customers would have had no idea about this company and their porn if this suit hadn't been filed. I know that I've never heard of this company. I see it as a situation where they are bringing more attention to the company by complaining about it.

Also, parody of something has protection to some degree under fair use. It's not black and white, but there are some ruling where parody has been found legal within trademark rulings.
