He didn't open them all the way to take a card out, just enough to see if there was a hit in there....aka pack searching.
The vast majority of hobby shop owners are savvy to pack searchers, but even if you're not, why would you let someone get the packs out of the box on the floor...what good could possibly be coming from that?
I believe that is much further than pack searching. That is fraud. Its not quite stealing though so the limitations are different. I can't believe that people go that far to find a "good" card. Do people not realize that they can go to jail for this?

I consider it exactly the same thing...doing something to figure out if there's a hit in the pack. What's the difference of opening it a little and bending it a certain way, you're getting the same information.
