I need eBay advice please
I sold these Gretzky's in this listing:

Buyer is in Russia... he had an US address in his offer and then changed it to Russia when he paid, when I noticed the Russian address I requested he send additional shipping to cover the extra cost. Shipped anyway and never got it. He paid $18 shipping, it cost $45..... besides the point.
He received the package today and this is his message:
Hello!
Just received 3 GRetzky AUTO's I bought for $350 from you.
One of them (xx/50) has a spot on inks of auto, like small drop fell on it and spread ink a bit. It's not too much but it's visible. It's visible even on your scan - the bottom of first 9 in signature on Gold /50 card. Now it's visible but was very diffecult to understand what it is before buying na dyou description also didn't contain any notes.
So now I am asking you for a compensation becouse such auto can't be considered as mint/NM.

They were listed as NM. (not NM/Mint). I think the conditions are well beyond NM, the auto's were clear on the listing, and he has no claim.
Am I right? How do I handle this? Need your help people. Thanks for your time and input! -Jason

My listing offers a refund minus shipping, thinking I will say you keep them as is or return them at his expense for a refund. Seems best. Any other thoughts?

He admitted he could see the spot in question in the scan. If he could see it and did not ask any further questions before he purchased it then you did nothing wrong. He needs to ship it back at his expense or keep them as is (in my opinion).

I never give partial refunds through eBay. I hate to say it, but too many buyers take advantage of the system and back sellers into corners by leveraging feedback, etc. to get their cards and their money back. I agree that there may be instances where a partial refund could be warranted, but why open the door. [I also don't sell as a full-time business, so I don't have 1000s of transactions a month which might make it easier to give in to a buyer or 2. The couple of requests I seem to receive every 50-75 transactions seems like a lot to me, especially when I provide reasonable scans and point out chipping/damage to any card where it is visible...]
eBay/Paypal has a system where an unsatisfied buyer can open an 'item received not as described' case and they can return the item to you (with tracking) to receive a full refund. I believe the policy has recently changed to where if they contact you, you offer this, they refuse and leave you negative feedback, eBay will cancel the negative feedback. Part of their 'seller protection' program (laughing under my breath).
Again, I don't mean to suggest that every buyer is unscrupulous, but in the over 500 purchases I've made, I've received 1 damaged card - which I returned for a full refund even though the seller offered me a partial refund to keep it. And in 300+ sales, I've had more than 10 requests for partial refunds, but oddly, have never had a buyer return a card.

That's what I'd do too.. Make him ship it back at his expense if he doesn't want it. The mark is visible in the scan and he admitted to seeing it.

Me too. thats why I want to be very careful and cover all the bases before I make my next move.

okay they ae not MINt..the auto is clearly smudged..but..you overpaid in shipping..
Tell him your paid 45$ and he only paid 12$..so the difference was compensations..plus its the cheapest one of them all that has a minor smudge...so yeah dont send him money , ive dealt with 1000 of people on ebay..sold over 2000 items...trust me don't overdue it..worst thing that will happen is a neg feedback..and who cares..i got one before..never changed anything..
