    Hooray! another paypal/ebay problem

    Well, usually in these situations I'm the seller and not the buyer, but this time the tables have turned. Bought a card from a seller for $28, not exactly a high priced buy. I receive the card, and first thing I notice is this:



    Once i take the card out of the top loader, I look for more damage and sure enough, crease right down the middle...



    it's kind of hard to see, but you can see the waviness going up the center of it.

    I e-mail the seller and politely ask for a refund because it was not in mint condition like the auction stated, and she told me she couldn't because the post office did it. I gave her one more chance before filing a claim and she hadn't responded. So i filed the claim. Turns out in her feedback, despite being above 99% (I think 99.5) She has had several problems in the past with damaged cards, ect..)

    My question is, do I ding her with a negative feedback after the result, or should I just let be with a refund (if it comes out in my favor, which I have a feeling it will)?

    I'm a seller on ebay, and that's the risk you run with cards is that 99/100 times the card will get there fine, but if your really want to be sure, make the buyer pay for insurance. I've been dinged on it a couple times, but i always bite the bullet and give a refund cause I know it's not going to end well for me.

    Any thoughts appreciated, thanks!

    I would say that if you get the refund, leave it as is without comment. Perhaps even offer to send the card back to her; that way it's pretty much status quo ante, except for it being damaged.

    Oh the card will absolutely be going back, doesn't me no good in this condition anyways. I guess I'm just thinking she's trying to pull one over on me. Why wouldn't you just give the refund and be done with it? I shower her the pictures, and yes still went this route. Going through all of this alone make me want to give her a negative just for being stubborn...

    i dont think its the post office's fault. anytime you ship out cards you should be responsible for protecting it well!! GL on getting this resolved!!

    did you buy insurance? if not, then what happens, happens. why should the seller take the loss on the card when it wasn't their fault the damage occurred? filing a chargeback just because you can under paypal's retarded rules doesn't mean you should.

    ...and this is from the point of view of a buyer as i don't sell on ebay. since you sell yourself, i'm surprised you don't feel the same way.

    if anything, a compromise of a half refund would be fairest since both of you are losing out.

    I'm just abiding by the system. Why should I give up on $28 dollars when I know that's not how the system works. How do I know this person didn't run over the bubble mailer with their chair? Sit on it when putting it into the car, ect... Lot's can happen on the way to the post office, that's almost like a license to send out shoddy items. Plus this person has had issues protecting stuff in the past as well. Am I supposed to just be trusting this time and shrug my shoulders when every other person in the world of ebay plays by other rules?? I've sold probably about 1,000 cards on ebay, and 1 has come back damanged, and the bubble mailer was clearly messed up by a machine at the P.O. however, because I knew the system I simply refudned the money and shrugged it off as "just doing business". If i'm that bent about a card, then i require them to pay for registered shipping, DC, Insurance...whatever. i don't feel bad for one second filing a claim, and not even for revenge matters, but as screwed up as the system is, it's finally in my favor. So why would I just donate my money just for the sake of it??

    i'm going to trust that some things just aren't communicated well online. by your method of thinking, it is ok for scammers to file chargebacks to rip people off. they are only "working within the system." obvious rights or wrongs aside, scammers also know "how the system works."

    actually, i can see where you are coming from since you can take your chargebacks as a seller and move on as well. you are right in that you are only working within the system. it happens to you, you move on thus it'll happen to another seller and they should move on to. it's just business. my comment above was simply from my own perspective of treat others how you wish to be treated (retarded paypal rules aside). if i sold and this happened, how would i try to work it out with the buyer? more often than not, taking the high road usually doesn't benefit the person who takes it though.

    And I would much rather take the high road too, but i guess it boils down to that this person was unwilling to even try and compromise with me, so I feel like I'm being taken advantage of (especially given their history, which I probably shoudlv'e delved into deeper than just looking at the %). To me it really is something that just happens to sellers, sometimes the charge backs are real, sometimes it's just a scammer. You just learn to minimize it as best you can and not P*ss off the customer, because it'll come back and bite you in the butt. And you're definitely right, that the person usually taking the high road usually ends up on the short end of the stick.

    And that sucks you're card got screwed up like that. That is (was) a sick card!

    looked like some serious damage too!

    I would be shocked if a card came in the mail like that!

    I dont think the PO accepts damaged envelopes,
    if you tried to mail a damaged card? not sure though (never tried?)

    but it seems as though it would be the PO's fault, shouldnt they have
    to pay for it, even though you dont have insurance on it?
    Or I suppose, this is the reason why they sell insurance?!?

    please mark your envelopes "Do Not Bend!" & "Hand Sort"

    it will help prevent accidents such as this.

    I had the same thing not too long ago - It came to me damaged and the seller was unwilling to deal with me and forced me to file a paypal claim. After I filed they never responded Paypal said I needed to send the card back and after I showed that it arrived then they would issue a refund. I sent it back to her in the same shipping method with signature confirmation to cover me....I would recommend the same for you - as now with the new rules you have to cover yourself also, and who is to say if you are the seller - "Sorry I never received it back" and if you can't show that they actually received it you are out the cash. As for what feedback you should leave - it is totally up to you as you have to leave what you feel is fair and just - be it a neutral or negative.
