Need to vent about an ebay purchase gone wrong!!!
so I buy an iphone 4 and have to upgrade my OS software. I turn to ebay as I can't get the proper OS retail. I need leopard instead of snow leopard.
anyway...
I buy a copy for $133 dlvd. It arrives and when I take the disc out of the box it has some damage on it... Not terrible but more than normal wear. I go to install it and my computer won't authorize the disc so I take it out and put it back in and bypass the authorization step and see if it will install that way. It basically does a half install and my computer isn't running an OS. I reinstall my old OS and set up a return for my disc and buy another install disc on ebay. I contact seller about the disc and he says he will refund my money when he gets the disc back and can determine the disc hasn't been switched. He gets the disc back on saturday and never contacts me. I message him on monday. no reply so I go ahead and do a dispute on paypal to make it official. He replies that the damage was done by my computer, but also claims that the disc works for him. Then says that he doesn't think he should have to return my payment as he would be stuck with a disc that doesn't work. I'm confused. does the disc work or not?
The guy has 1 neg and 1 neutral since I bought the OS disc. One of which is listing something not at the correct quality type. I'm hoping paypal comes through for me this time. The guy sells a lot on ebay so I'm hoping if I do win the case his account won't be empty. Something tells me I'll be on the phone with paypal in the not so distant future.

It sounds like the seller is trying to pull a fast one on you. I'd definitely go forward with the Paypal claim as soon as possible.

yeah, it's into the claim process. he actually escalated it himself. It's just frustrating because I know how paypal can screw you over and even if they file in your favor you can still end up without money because the account is emptied.
The damage to the disc doesn't seem like it would have been made in shipping so I'm fairly sure the guy knew it was damaged. He has other feedback issues where he's incorrectly stated conditions of items that he was selling. I feel that I don't have to prove that it was damaged when I got it. Besides he has the product and thinks that it is right for me to also have to pay him. Like I said I'm not sure why he's saying the disc works fine for him and then complains about having a damaged disc.

wow the seller sounds like a total jerk sounds like what happened on half.com which is affiliated with ebay or something i bought a book and it never came so i waited....and waited....then contacted the seller and he messaged back saying he like ran out of it and was gonna get another one so i waited...and waited...and then messaged him again he said he was gonna send it soon so i waited...and waited...and then i contacted him again and he says he'll send it soon if i still want it so i agree and so I waited...and waited...and then finally i just got fed up and eventually got refunded.
morale of the story...ebay and site similar to ebay have some crappy sellers

I reread his paypal message and he definitely says that he shouldn't have to refund since the disc was not damaged when he shipped it and then turns around and says that the disc works fine on one of his machines. I guess he thinks it's more fair that he gets a disc that he says works and my $133.
yes, on half.com it would have been a much easier return. They have control of the credit card charge rather than the seller directly taking payment. If they don't rule in my favor and the guy hasn't cleaned out his account I'm going to be quite upset. The guy won;t even reply to multiple ebay messages that I have sent.
He'll get a negative either way.

If the guy has an actual business on ebay and paypal finds in his favor I would message him again stating that you will make a compliant with he BBB in his city/state....

he sells a lot on ebay so at least I'm hoping he won't empty out his paypal account.
