URGENT: HELP NEEDED! ebay thief.

Buyer Beware.
Heres the story:
Two weeks ago, I purchased a Getzlaf Cup ARP Gold 15/51 from him after contacting him through ebay messages. We eventually came to a deal where I would send out some money through paypal and the rest TTM. It has been two weeks and this card is nowhere to be seen. I've contacted him several times through eBay messages; however, he has not responded at all. Earlier today, I was flipping through his feedback, and apparently this isn't the first time that he has stolen money from other eBay users.
Anyway, the predominant point of this post is that I need your guys' help. I have already filed a dispute on PayPal. As for filing complaint on ebay, I don't think I would be able to do so, because we made a priavte transaction.
Was there anything else I could do to get my money back? I know that there is probably no way how I can get the cash that I sent TTM back, but what about the money that I sent through PayPal?
I do have his address and paypal in hand, and I was wondering if I could take any legal action. If you have more information about this, please let me know!

Also, if anybody sees this card, can you PLEASE contact me ASAP? Again, it is an 05 The Cup Ryan Getzlaf Auto Rookie Patch GOLD Serial numbered 15/51. I believe it is a 4 color patch (white yellow teal black).

It can take 5 weeks or more for a card to arrive from the states. In some cases I have waited 2 months.

in this case, I flipped through his feedback.. there have been 5 separate occasions where he never mailed out a card. (One of them being another Getzlaf Cup ARP). He also said he would mail xpresspost which should NOT take this long.

Why'd you go off eBay to make the transaction? That kind of ties your hands right there, because while you have proof of the Paypal transaction, there's no proof of your sending out any amount through the mail, not that I'm saying you didn't send it, but you can see where he'd be able to get out of sending the card, even if there were legal proceedings (which, honestly I'm not really remembering anything similar as far as statutes go) essentially, the burden of proof would be on you.

yeah there's a lot of things you can do...
it's called theft by deception and you can take legal action...
but is it worth it? i had a simulair issue with someone on this site, and I ended of coming out of it fine, but wow.. was it stressful

It doens't matter how he sends it. It's still going to take at least 2 weeks minimum to get to Canada from the US. I'm sure he didn't send out until he got the money TTM either. So you're probably waiting at least another week or two.

i sent the money out with tracking.. so I still have the tracking number on hand. As for xpresspost, I guess I'll just have to keep waiting. This guy has a rep for NOT responding his messages and considering how he alrady stole money from another ebay user buying another Getzlaf up ARP, it still raises a red flag. I guess I'll just wait and see. And no, I didnt send as a gift either so I should be able to get the money bac *HOPEFULLY*

It should raise a red flag any time you see an ebay seller with less than 99%+ positive feedback... This one rests solely on you man, you could've worked out the deal through ebay, which would've kept you safe, but you went off site. When you're going to spend the money it takes to buy a high end The Cup Gold ARP of a player like Getzlaf you should get a feel for who you're buying from, and one click on his feedback would've told you he's probably not reliable. At least now you'll be more careful on who you deal with and here's to hoping you do wind up getting your card. This could all be much ado about nothing though as it is an international deal and mail to/from Canada is never quick, especially, as v3rs3 said, he's probably waiting for your TTM cash to ship the card out...
