Yes, that is what I would do. Too bad you didn't get it on eBay, as if you did you would probably end up with the book for free and the overdraft fee money, knowing eBay's buyer protection.

I don't really see where you have any grounds to ask or receive a refund for your over draft fees from the seller. It's not the sellers fault that you didn't have enough funds in your account. I get the issue that the funds were taken out later than you thought, but if you'd balanced your account you would have known that those funds were essentially going to be gone from your account at the time of purchase. If you'd looked at it like that your account would have shown a surplus of $42 until it came out of the account.

It's unfortunate but not really the fault of the seller.

I do find it weird that your account wouldn't have been effected until he marked it as shipped.

one thing i forgot to mention in the original post is that after i placed the order i checked and my online banking had listed those funds as being held for all the books i purchased since i purchased them all at once so it listed like 300 something as being held and so i didnt think much of it after that because i figured that was that.

Amazon has always done this with my account. My CC will not be billed until the item has been shipped. This typically happens on items that are back ordered.

YOU spent too much money so YOU are entitled to NOTHING!

If someone double charged you that would be another story.
