need help, ebay damaged card..
hey guys, bought a brodeur jersey for a set im working on for 30$.
got the card today, camed in a bubble mailer without any cardboard or decoy, just sleeve and lloader. card have 2 creases arou8nd the jersey.
i wrote to the seller that Im asking a refund and it was is responsability to send a 80$ bv card with a decent protection.
the answer :
Sorry i cannot refund money, as i clearly state in the auction it says bubble and/or cardboard protection. I also clearly state the card is Near mint to mint. Also, Creases would not happen because their is no cardboard, that doesnt make sense. You shouldnt bid on cards if you cant afford them. I apologize again, but will not refund money, everything was clearly stated in the auction listing.
no way I will loose 30$ on that damaged card.
I will claim with paypal as well, but I never claimed with paypal for a received damaged card...
please help me make the good thing here to get my dollar backs.

not sure there is much to be done..try making a case...but pretty sure its useless...

try offering to send the card back? I wouldn't know what to do in this situation but hopefully you can get refunded. Odd how the card would get damaged in a bubble envelope in a top loader. never have I ever seen that before in my 600 trades here

Like i told you by email a Seller on ebay is 100% responsible if somethings gets damage while being shipped

File a claim and make note of the damage - they may ask for a scan so definitely be prepared to have one. Sellers can scream until they're blue in the face that they don't offer refunds and the like but they are responsible for safe and secure delivery of the card. Your card is damaged as a consequence of their shipping, and whether they like that or not those are the rules.
You can also try to offer to send the card back for a refund so that he can see the proof for himself.

Kostit: I completely understand what you are saying and I agree with you.
You asked for extra protection and the seller ignore it. File a claim through eBay and sue them as your advocate. They will hold the funds until a resolution is found.
With that said, I have seen SEVERAL cards get creased around the jersey piece inside a soft-sleeve and top loader inside a bubble mailer. I alsway ask for decoy cards to surround these cards because of this very issue. Bubble mailers really are not enough protection for those patch cards unless they are in a hard plastic case like a magnetic one touch holder.
It is shame that you have this problem. I hope it gets resolved in the manner you feel fit. Good luck and keep us posted.

this is the second message he sent me :
I'm sorry you feel that way, that is why there is a picture of the item and it clearly states near mint to mint. I will have to fight this unfortunatly, but i must do whats right. I cannot return things because people dont understand what the auction listing rules mean, thats why we have them. I apologize again, but like i said, will have to fight claim

after in paypal take the option damaged in shipment?
I cant see with the auction picture( if the creases are there)

You can file a claim with PP for item not as described and you will get your money, PROBLEM is, is that you have to send the card back with tracking so that could cost you. PM me the ebay ID please, and I may also be able to help you further with this via PM

If it makes you feel better, I got a $600 dollar card in the mail a few weeks ago and the corner came damaged to the extent I couldn't look at it without being annoyed and frustrated.
Thankfully, it was on the back of the card and the seller claimed to not have seen it, and gave me a full refund and relisted it with a disclaimer of the damage.
However, I have had a seller refuse a refund before, and if you make the claim you will 99.9% get your money back. Go through the ebay resolution, which will send you through paypal, and go through the claim of "item did not come as decribed. Simply say that ZERO damage could be seen from the picture and none of it was in the item description, and you will get your money back through paypal.
That being said, be prepared with a picture of the damage, because I have had paypal ask me for a picture of the card so they can compare it with the scan in the listing, but breathe easy because you will get your money back bud.
