    eBay Fail: What Should I Do SCF?

    I've been dabbling in some group breaks so far this summer and I figured to help me pay for the fun I'd bid on this little diamond in the rough on Monday night and relist it for a nicer sale:

    1988-1989 OPC Hockey set won for $22.72

    Well it comes in and much to my dismay it turns out to be the 1989-90 OPC Hockey set.

    What should my expectations be as far as a refund? He has a no return policy and I have the eBay Buyer Protection.

    It cost him $7.05 to ship it so even if he refunds me the price minus shipping I'm stuck with a set that I can only make a few dollars on after shipping.

    Looks like it's no 88-89 OPC set. What should I do?

    You should be able to get a refund as the item was not described properly.

    Place your claim and add on the additional Shipping to return the cards. He made the mistake, not you.

    If he balks, and will only pay one shipping cost, then Neg him and One-Star him to death.

    They actually described it as the 88-89 set, not the 89-90 set.

    "Near mint set is loaded with many rookies including Brett Hull, Brendan Shanahan, and Bob Probert"

    Brett Hull's RC is 88-89.

    I'd get a refund or hold it to them.

    Here's the problem with eBay - you have to pay the return shipping with tracking in order to receive a refund. And you will not receive the return shipping as part of the refund. You will get back the original shipping, but the cost of shipping the item back is entirely on you. And eBay requires you pay for tracking back to the seller or they will not refund you. EBay's Buyer Protection is awful at best. EBay is awful at best.

    FRom Paypal's site:
    For Significantly Not as Described (SNAD) Claims, PayPal may require you to ship the item back to the seller - or to PayPal - or to a third party at your expense, and to provide proof of delivery.

    For transactions that total less than $250, proof of delivery is confirmation that can be viewed online and includes: the delivery address, delivery date, and the URL to the shipping company's web site if you've selected “Other” in the shipping drop down menu. For transactions that total $250 or more, you must get signature confirmation of delivery.

    However, if you contact the seller and explain the problem, they might be willing to give you a full refund. You don't always have to go straight to the dispute process. Sellers are human too and can be honestly mistaken. You might be surprised by the resolution (ie. Maybe it was a ship error and he'll let you keep the worthless set for free and send you the correct set).

    Of course, if the resolution proposed isn't satisfactory or if they don't communicate, then Paypal's SNAD + proof of delivery are your only choice.

    I'd contact the seller first.

    His listing says RCs of Hull & Shanahan. It may be an honest mistake that he sent you the 89-90. Costly... but honest. Always give the seller the chance to redeem himself. (In fact, the newest rules require that you contact the seller before starting a ticket to be able to leave a negative. If you jump right to dispute, the seller can have an eventual negative removed.)

    Worst case is that you will end up on the hook for shipping it back with DC, of course.

    Write it off and hit the seller with a negative. Not worth all the bs going back and forth then having to pack it up and ship it.

    After the second attempt, the seller got back to me with a full refund so I guess a free set of 1989-90 OPC worked out pretty well...after reading these posts it looks like it could have ended a lot worse.
