    I thought maybe it was scratched in the picture, I gotta admit that was the first thing I checked. But on my card, the area is COMPLETELY scratched off, no silver left at all.

    Unfortunately, I think you are gonna be s.o.l. Ebay doesn't care about the buyers. Your purchase wasn't made with pay pal, and I think that would have been your only chance at a refund. I doubt very seriously that ebay will refund your money. I hope you get it, but don't hold your breath. I hate scum bags like that !

    Uh... no. Doesn't matter who has it... it's who put the code in. What if I redeemed one and then gave you the redeemed redemption card. You think you would be entitled to the card because you're now the owner? Nice try.

    Contact Chris Carlin at Upper Deck and provide him with a scan of the redemption card and code, and the link to the EBAY auction. Make sure you print a copy of the auction page showing the card because after a certain amount of time EBAY dumps the auction listings. Legally you have proof that you purchased the item with that code with the understanding that YOU would be redeeming it for the actual card. UD will honor it for you, their legal department will know if they send the card to the seller then they are sending him basically stolen property and they will not want any part of that.

    No one gave anyone anything, it was a legal sale of tangible goods. I think you need to brush up on your law skills.
