I strongly disagree. A seller who states "NM or better" should provide exactly that - cards in NM condition or better. A buyer should therefore be prepared to be happy with a NM card (and apparently there is some debate about what constitutes "Near Mint") and if it is in better condition than NM, then great! I personally generally state cards are NM/M (or NrMt-Mt depending how I'm feeling that day - so much simpler to write "NM/M") or better unless noted, which is what I and many others consider "pack fresh". Indeed, you might get a Mint or even Gem Mint card from such an auction, which would be great...but no buyer should assume that would be the case.
If a seller just states, "card is not mint" then a buyer should be very careful, as that card could be Ex or VG or whatever condition. I would not buy from a seller like that.
If what you are really trying to state is that the seller should assign a certain grade (which is what they would have to do if not using an "or better" statement, else risk losing potential buyers like me), this has its own risks (e.g., buyer submits to PSA or BGS and gets lower grade, then comes back to seller to get a partial refund), unless you disclaim all and any responsibility for the grade - which doesn't exactly instill confidence in the buyer.
I have bought thousands upon thousands of cards and have received probably fewer than 10 cards whose grade has been actively misrepresented as better than it was. It's up to the buyer to make sure they know what they are getting and to ask if there is any confusion. From my experience, this doesn't seem to be even a minor problem.

keep shipping cost reasonable , clear scans ( if single card sale , don't use a group scan ) and if card has some slight damage be honest and say so , make sure you don't miss spell anything or your cards won't be found

Agreed that it is important to keep your shipping costs reasonable and also to clearly state your combined shipping policy. I charge a flat rate (all additional items free shipping after the initial fee) and look for other sellers who do the same (or who offer free shipping). Sellers who add 50 cents for every win don't exactly inspire me to look at their other auctions, as that can add up quickly, but 25 cents per item or a cap on max shipping will get me to at least look at what else you have.

What about with starting price of auctions and such... before i joined the forum i found that if i started auctions at 99 cents, more eyes, more watches, and more bids rolled in on them.... but in this thread alone ive seen like 6 or 7 ppl saying thats not a great practice, and to quote one guy "75% of the time you will be disappointed" ... sooooo i listed a lot of things this week, almost all at BIN/BO haha... I'm so conflicted :p

As a buyer, if I see an item I want that is BIN/BO, and is in the ballpark of what I could get it for on auction, I'll jump on it. Sometimes it's just worth coughing up a couple extra bucks to avoid the hassle. Free combined shipping guarantees I check out your other items.

That's entirely up to you and how much control over your selling prices you want to exercise. I personally prefer BIN/OBO - most of the time I get very reasonable offers for cards and sometimes get very pleasantly surprised at someone outright hitting the BIN. I like to give myself room to haggle with the listings - all part of the biz.

Sellers who put ridiculously high prices on BIN/BO then send you an offer back of $2 less then the original price that the item was for.
