For you or I, yes. However, this is business and you are dealing with trademarks and brand names.
I actually thought UD would have filed infringement charges. I think Topps is a registered trademark which UD acquired when it got Topps' hockey license. I didn't think one company could blatantly peddle a product trademarked by someone else without legal penalty.
Besides, ITG does not have an NHL license.
If I were to sell iphones from my house without an agreement in place with Apple, I'd be in jail faster than you can say megabyte. What ITG is doing is similar.

ITG are selling previosly sold product that they bought and paid for just like anyone else , so going back to your example on Iphone's , you can absolutley sell I phones out of your house as long as you show proof that you previously purchased them legally of the market and you are able to provide all info of the transaction , ITG can , as they bought all these cards of ebay and other sites and from dealers that can provide proof of purchase , therefore it is %100 legal for ITG to recell them , it is no different than a local card shop buying a card and reselling it few days later . upper deck does the same thing , in my PB i have a Roy 2nd year OPC card that upper deck bought had him sign it and reinserted it into packs of 08/09 OPC as a buyback , back in 1987 upper deck did not own OPC so they did not own the rights to this card . but since they bought it off the open market like anyone else they can .
