    ebay help

    a seller had an item i wanted, so i emailed him and we made a deal that he would sell it for $50. i paypal him the money and then he decided he wanted to keep it listed on ebay. does this constitute a contract since we both agreed on the transaction.i have the documentation on our agreement and i can get the paypal copy of our transaction. is there anything i can do to get the card? i dont want the money, i want the card i bought. any one what i can do? i know ebay wont do anything about it, but can i contact the police department. doesnt the card become my property when i paid him?

    Have you tried contacting the seller? Perhaps it was an oversight on his part.

    If you contact Ebay, while they probably won't do anything, they may be able to suggest a course of action for you.

    As for getting either. You should probably just take the money back, as I don't quite know if the police can do anything...perhaps you could go down to your local station and ask for advice.

    I don't think you can do anything about it since you made the deal outside of ebay. What you should have done is had the seller revise the listing on ebay to accept offers from buyers, then you make the offer and he accepts.

    I hate to say it, but I think you're going to lose this one... I would be thankful if I got my money back. I believe since you circumvented the ebay process, you legally don't have a binding contract ...

    Yeah, always have them list it on ebay if you have never dealt with them.

    i talked to a policeman today and since we had an agreement andi paid. then the card is mine. as of now hes selling stolen property,

    It's actually not that simple. I'm willing to bet you didn't give details to the cop...or the fact that you both broke eBay rules. You better just hope you get your cash back, because from what I can tell you aren't getting the card.

    Actually, it's not against the rules to make deals outside of Ebay, it's just strongly not recommended

    Actually it depends. There are specific rules on it based on ending auctions early, who is the highest bidder at the time etc...we don't really have enough details to know it it was a violation or not.

    it is against EBAYS rules to do what you did, so you get no help from them....the police aren't gonna help you cause you got your money back....just be glad you got that and go about your day....nothing more you can do, nothing illegal was done here
