That's looking at it from the lawyer's standpoint and how to defend cases like that, but I see your point. Still, that doesn't mean he was arrested because he was black and it doesn't mean it was "government intrusion" or "excessive use of government power" as this quack is claiming. The guy was arrested because he was yelling at and aggressive towards a police officer...is this the first time that's happened, because that's what people are acting like.

I agree, wow...but that has nothing to do with what happened to Gates. That's a different officer commenting after the fact.

I understand your point earlier about two guys walking around a house trying to get in, especially in a white (meaning rich) neighborhood....that would probably get the cops called in my town too. But once the officer determined that it was in fact his home, that should've been the end of story....regardless of whether he was yelling or screaming or insulting. Police officers enforce the law, therefore they should know the law. Any lawyer worth a dime is going to have those charges dismissed.

First of all, he tried to do that...he was walking out of the house to leave and Gates was following him still yelling. But even so, the arrest has nothing to do with race or big government intruding on anyone's privacy. Mr. Gates was not arrested for "being black in America" and he certainly wasn't acting like the saint everyone is making him out to be. I'm not arguing whether or not he should have been arrested, I'm arguing that he was most definitely not arrested for the reasons the media and the Obamastration have said he was.

The lady that called the cops was not a neighbor. Thats why she didnt know gates. The audio tapes clearly show she never mentioned race. There was no racial Bias there. gates was renting the house. He did not own it and it was not his primary residence. after the fact, judging by his attitude, I doubt he was too openly freindly with his white neighbors. i think its unfair to blame the perceived rich white neighborhood that surrounded him for his racial Bias. We can argue about disorderly conduct and cops abusing their power all day. that is a seperate issue. Unfortunately gates, the media, Obama, and the guy writing this article continue to try and convince the public that this is a racial issue, which it is not. The guy writing this fails to mention that the only reason this is a partisan/political issue is because Obama got involved.

Officers version of events: According to the police report and interviews with Sgt. Crowley, the officer asked Gates to step outside
Gates version of events: Gates informed the officer that Gates intended to file a complaint against him, repeatedly asking the officer for his name and badge number which the officer would not provide. Sgt. Crowley instead told Gates to step outside his home. Gates followed him outside, onto his front porch, where Sgt. Crowley arrested him.
It seems that both men pretty much agree that he was not stepping outside to leave.
I also don't think many people are making Gates out to be a saint. In fact, the article in the OP you called ridiculous doesn't make him out to be a saint.
Another thing....Officer Crowley asked Gates to provide ID, which legally Gates did not have to produce but did, and Gates asked Crowley to provide identification (full name and badge number), which legally Crowley did have to produce but didn't.
Also, when Crowley arrived at the home, Gates was already inside. Crowley had no business opening the door and walking inside unless explicitly allowed by Gates.
Officer Crowley wrote in the police report that "possibly two black males" were trying to enter the house, and that he obtained this information from a brief encounter with the 911 caller outside the home. The 911 caller says the officer said nothing to her other than "Stay right here"
okay, let me just be clear on this...Gates obviously could've made this situation a lot easier on himself, but LEGALLY, he did absolutely nothing wrong!
The article in the OP I think is far from ridiculous and actually makes some pretty good points.

Gates did everything right until he decided to start ranting. I totally understand some angry comments or even some yelling but by the sound of it, he kept going and going and going. I'm sure the police officers were confused as to why this man was continuing to insult them. It's suspicious, is it not?

Then he should sue the Cambridge Police Department and let it be decided by a jury of his peers.
