If you look at the "real one", it indicates right on the card "AUTOGRAPHED Ultimate Debut Threads Patches" - they are numbered to 35

With the "fake" card, the design is different and there is no indication that it is to be autographed - based on this, I would conclude the card was not released by Upper Deck with an autograph on it, unless it was signed in error

Hmmm...I hadn't noticed that. The only way to be sure then would be to have a scan of the back of the card. If the congratulatory message does not feature the recognizance of an autograph on the card, then most likely the card could have been an error in numbering (#/25 instead of 35) that the seller or original owner of the card took advantage of to maybe fake the patch and either fake the auto or get Niemi to autograph it in person.

I tried to point out to the seller Rollerman that he was selling a fake, and I got this response:

I PICK THIS CARD IN A CASE OF ULTIMATE 09-10
THIS IS A REAL PATCH NOT A FAKE
DON'T BID OR SEND AN OFFER IN MY CARDS IN THE FUTURE

So I guess he didn't appreciate my kind gesture.
