    Need Some Help With a Customer

    Hey everyone, so recently I sold these three cards to this guy on ebay about a week. Just yesterday, he claims that he only received one of the cards and the other two were missing. Here is exactly what he said:

    I paid you in full for three items; $ 44.49: 180419096694; 180419097408; 180419097063! You only sent E. Jones # 180419096694, why? I want an explanation immediately. I hope that you are shipping the other 2 items later. Please do not force me to take other action.

    Why did you only send one item and not all three that I won? I paid you in full thru pay pal $ 44.49 for 3 and not just the one you sent on 10/23/2009! The one that I received in the package is # 180419096694 ( E. Jones ). I want an answer immediately or I will contact Ebay/ Pay Pal!

    Now, I know for 100% certainty that shipped out all the cards together, so I responded like this:

    I sandwiched all cards in between pieces of cardboard. There should have been two sandwiched pieces in the bubble mailer.

    The EJ was sandwiched by itself

    And the two Derek Fishers were both sandwiched together.

    Did you make sure to check inside the packaging completely? The other sandwiched piece might still be inside, because I'm sure I sent everything together.

    Also, just so I know I sent you the right package, do you mind taking a picture of the bubble mailer i sent you? Or could you just tell me if it was a small bubble mailer or a medium sized bubble mailer?

    However, I also began to think what if i shipped those cards to the wrong address. So I also decided to email all the other customers who also bought cards from me that week, and asked if they received the 2 Derek Fisher cards by accident. All of them emailed me back saying that they have not.


    Anyways, here is what he emailed me today:

    Hey Seller,
    The package was a small bubble mailer. The only item ( 180419096694: E Jones ) was by itself when the package was opened! I checked the package real carefully after it was opened. There were no Derek Fisher autograph cards. I suggest that you check your work area and send my two missing items. I will wait for an answer from you of an up-date of my 2 winning auctions of Derek Fisher. I hope that you send both items soon or refund my money! You may contact me @ my cell phone ___-___-_____ if you like.

    Now, at this point, I am really confused because I really thought it was just going to be a misunderstanding and that he overlooked the cards at first. Anyways, i responded like this:

    I really don't know what to tell you because i know with 100% certainty that shipped out all the cards together.

    I mean none of this is making sense to me...Just so you know, I did email all the other people who bought something from me that week just to make sure I didn't mail those cards to the wrong address. But all of them confirmed that they didn't receive any Derek Fisher autos.

    Unless a guy at the post office some how opened the package and stole those cards, which I kind of doubt, I really don't have any other explanation for this. Just make sure to check the package thoroughly again because those cards should be in there. Like i said, I am 100% certain on this.



    I'm going to wait until tomorrow and see what he says.

    Now though, I really just have this funny feeling that this guy might be lying to me and is just trying to force me into giving him a refund so he could get the Derek Fisher cards for free.

    So, what do you guys think, do you have that same feeling yourselves, or should i give him a refund?

    And just so you guys know, i really don't care if he ends giving me a negative, I used another ebay account that's not my primary sellers account, so it really doesn't hurt me too much.

    My main concern is the money, which isn't much but still i don't want to give it away. Do you guys think I should let him file a claim with paypal and see where it goes from there?

    Because I do have the DC# the shows the package was delivered, and I just feel confident that i will win that claim.

    Anyways, again, what do you guys think? thanks!

    Hmmm.. thats kind of tough.. how is the buyers feedback? If it doesn't look like he has done it before and has a decent amount of feedback, you might have to trust him on it.

    I just had a recent issue with a seller on ebay and accused him of resealing a package and in the end he accused me of trying to scam him. It really didn't feel good to be accused when I know I was wronged.

    If you don't know what happened to the cards, you should take responsibility. You may have accidently shipped it to someone else and then they just told you they didn't receive anything. Who knows..

    what's the buyer's feedback rating and how long has he been a member? Same question for the Ebay acct you used to sell. The DC# definitely helps your case, but you never know.

    That’s for all the comments and suggestions guys!

    I’m going to wait and see how he responds before I make my final decision on what I want to do.

    I mean it’s only $25 that I’m going to lose if I give him a refund, but I just hate people getting away with things like this. Especially when I KNOW I didn’t do anything wrong.

    IDK, there’s just a huge part of me that wants to call his bluff, and allow him to file a claim!

    The way I look at it, even if I give him the refund, there's no guarantee that he won't give me a negative still. So shouldn't I at least fight for my money, Right? I mean, I'm already accepting the fact that he will most likely give me a negative either way if he's a scumbag, so I will lose both ways if I don’t fight back.

    Another main reason why I would want to do this, is because it may benefit other forum members who run into scum’s like this. If I win the case, other sellers/forum members may not let buyers walk over them like this, and they too will utilize the fact that they have a DC# as proof of shipment.


    I will let you guys know how things turn out!

    You do have a very good point and I really appreciate your opinion. But I know without a shadow of a doubt that I shipped everything together, I only emailed the other ebay members just to make sure.

    To answer both of your guy’s question, this guy has been a ebay member for a very long time (since 2003), and he does have very good feedback it seems. But who knows, he may just trying to take advantage of the fact that I used a new account to sell these cards, and is trying to use it against me.

    The account I have has 12 feedbacks, with 3 positives from buyers. It’s primarily my buying account, but I decided to build my feedback and sell a few things. Plus, ebay had a deal with me that all auction format auctions will be listed for free, so I thought why not list a few things on there. Now with this situation, I’m glad I didn’t use my primary account.

    You know another member on HK made a very good point on the weight of the package that could really help me out.

    I doubled checked my receipt, the package I sent to him weighed 2.40 oz. .... Other packages that I sent that day (that only had one card) only weighed roughly 1.40 oz. Which means that there had to be more then one card in that package I sent to him.

    Yeah, so now with this, there no question this guy is scamming me.
