Military police handled my side here on base.

Weird that the MPs would handle a break in that isn't on base housing.

    lol what a cruel joke

I'm from Iowa and I believe the intruder has to be in your house -

I'm also from Iowa!! I suggest that everyone apply and get your license to conceal then you would never have to worry

Yeah I did wait. I had a gun on him, so he wasnt going anywhere. Plus he was crying. So I just kept the gun on him until the cops got there. So...when the cops got to my house, they saw what was going on, went over to the guy and he started saying stuff to me in spanish. I knew they were not nice words and I guess my adrenaline kicked in and I lost my temper and went after him. He already had one wrist in cuffs so he could've defended himself. But because I used to box, I guess i tore him up a little bit. He's suing me for his hospital bills and stuff like that. Broken left orbital, fractured jaw. LOL. He should've hugged me for not shooting him. But it is what it is. That's why I went after him.

Jeez, I thought you said you went after him. I think that qualifies as catching him :)

Knowing that, I would have my head on a swivel as these types of losers like to come back later and try to "get even". Even though he deserved it, he will still see it as he owes you. I would demand that the prosecutor let you know if they release him until his hearing or let him off with probation or a reduced sentence.

No no no...they're not handling my off base housing issues. They were handling the "why do you have a gun" part and they were handling the "assualt" part for my 1st Sargeant. My county police are handling my end off base. sorry...should've been more clear about that.

I am confused. You had to justify to the MPs why you had a gun in your off-base residence?

He's military and he has an engaged 1st Sargeant. If you're military and your Chain of Command isn't involved at this point they aren't supporting you.

Lawyer here. Most states only allow for "reasonable force" when defending one's property. Very few states (i know Texas is one) allow for deadly force when defending one's property. In general, common law states that deadly force cannot be used when defending one's property. Depending on if it is a bench trial or jury trial, the Judge or Jury would determine if the force you used was reasonable under the circumstances.

In regards to everyone saying he should have just shot him. Just ridiculous...ridiculous and disgusting. Theft is never justification for murder, regardless of the person's background of affiliation.

I beg the differ. If your a gang member and your in my house unwanted, I'm shooting, people don't get into ms13 for petty stupid little stuff, people in ms13 get in by killing, robbing, kidnapping, rapes.
