If you look back in his feedback you will see he "confused" another buyer who mistakenly thought it was a real card too.
Technically he did disclose that it is a reprint in the auction so I don't think you have legal grounds to dispute. However, if you press the issue he will likely refund you like he did krantz3001
(at least you didn't spend $176 .. ouch!)

Absolutely a reprint, nobody in their right mind would sell that card even in horrendous condition for that price if there was even a chance it was real, and that card is in nice condition.
