How did i handle this?
Bought a lot of mcfarlanes on ebay. and one was missing when i received the package. The seller said they would send out next day. They live like less than 2 hours away, I got the first package next day. I still hadn't received Saturday so i sent another message. Today i opened a case on ebay, which said.
Title and description describes i will receive 5 figures. I only recieved 4. I contacted seller a few times before getting a response.. they said they will ship the missing item next day. The Figure still hasn't arrived and seller will not return messages."
I received this message.
"I don't appreciate you saying I don't return messages. I responded twice to you. I work 80+ hours a week. I sent the replacement out to you. Tracking number is 420 02809 9405 5036 9930 0137 6668 71. Please don't contact me or bid on any of my items again. I said I made a mistake and didn't send the correct amount of figures and that I would take care of it. Apparently you do not have enough patience to wait for another toy. "
I was a little mad about them being so rude this was my reply.
"I'm sorry that you have to work 80 hours a week. But I sent you a message on the 10th you said you would update me the next day. I did not receive an update. You finally decided to respond on the 14th and told me it would be mailed on the 15th. You just you gave me the DC# and it says it hasn't been scanned by the post office at this time.USPS says "This does not indicate receipt by the USPS or the actual mailing date" So you can act like i am in the wrong all you want, but you are the one with my money and my auction item. Regardless of whether it is a "toy" or not. You know i wasnt even going to make mention that the figures smelled terrible like cigarette smoke. But your attitude is unnecessary and i don;t appreciate it at all. It's not like I left you negative feedback but I am just trying to protect myself."
Was i out of line at all. I don't feel like i was but i don't know for sure.

hilarious. I like hows the guy tries to downplay the transaction because it's a "toy". I also like the 80+ hours a week that he works. Maybe he should stop selling on ebay if his work limits him on when he can ship items. If he sent messages to you they will be in your message box on eBay, but I guess he can always just say that the internet ate them. You reply wasn't out of line. and I hate getting stuff that reeks of smoke.
Covered yourself perfectly. It seems like the action you took with the claim is what got you the item shipped promptly. Most of the time that's all that needs to happen. It's just dumb that you have to go through the trouble for a person to complete the transaction.
I sold a small lot of Jordans to a guy in new zealand. I invoiced him and nothing. Three or four days I message him again and then again 8-10 days. No reply. Then once I file the non paying bidder claim with ebay the payment comes in about an hour. Not sure why people deal online if they can't follow through.

His response wasn't really out of line until the last sentence. But, your response was fine. Although, after seeing your response, I wouldn't be surprised if the last one smells even worse than the other 4

Hey guys,
Just got this message from him.. I dont know if he is trying to play me... what should i do... If i close the case, is that me saying everything is fine... and then im screwed if it doesnt come in?

"I can't control the mail. I shipped it out to you, your holding my paypal account up right now so I can't purchase things for my business. Until this is closed, I cannot use ebay to purchase things for my business. If you don't get the figure by Friday then Ill refund you. I need this closed because I need to order things for my business."

All he has to do to free up his account is transfer the funds back to his PayPal account. They only freeze your account if you have a negative balance.

do not cancel the claim until it's resolved. If you do and he's lying you have no recourse. If he wants to give you a sob story about not being able to buy for his business then he can find funds elsewhere until you get the item. It's not you're fault.

thanks guys, i told him i could not do that.. I am going to escalate to a paypal claim if its not here today.. still no update on the usps site

the only time I did that when a guy promised the check was in the mail, I got screwed. Good decision.
