So an update... after a number of pretty angry emails and name calling (from sirernie12) He went and left his negative feedback, and thanks to the advice from around here, ebay has removed it less than 12 hours after it was left. Thanks for the advice guys. Much appreciated.

That's awesome - I'm glad that they did the right thing instead of simply standing by and taking the buyer's side as they usually seem to do. Score one for the good guys of the hobby community!

I dont know that they really had much choice this time, after seeing his messages to me, and to one of the other users, the girl in customer support was almost laughing. His last message to me was "good luck getting ebay to remove that feedback, I will make sure nobody ever buys anything from you!!!!" It was almost comical.... But it is quite frustrating, I had a buyer ask for an extra 5 days to make payment on an item, I accepted (shouldnt have) and when his payment finally came in 8 days later, I was on holidays. I messaged him to let him know this, and that I would be unable to ship for a week. He said thats fine. So fast forward 10 days after I ship, a case is opened for an item not received. I know he is just covering himself, but really? send me a message. A shipment in canada seems to take 7-10 days lately.... Canada USA takes at least that. Oh well sorry for the Rant, starting to wonder why I do this. Maybe I should just sell on here...

Certainly did not take much... I am sure as far as he is concerned what goes around will certainly come around.... I am just waiting to see my Subban on ebay or somwhere else. Makes no sense to me why you would take a serial numbered card....

Always use tracking. He probably noticed you didnt so he decided to play it off as he didnt recieve it to try and get a refund and the cards.

The cost of shipping every package with tracking is something I am sure most sellers would not do, nor could afford to do. Its just not cost effective for cards under 50. At what point does everyone require tracking to be purchased?

Well I do not know cost of tracking for Canada, but here its like .17 cents so its used regardless how much the item sold for and every person I deal with here uses it. Even shipping from Canada to Canada costs alot to track?

With US to US, deliv confirmation only costs 80 cents...on all purchases from me, I tack it on.
For US to Canada, on purchases OVER $50, I require $15 shipping charged to the buyer for registered shipping...it is clear as day to the buyer in item description.
For US to Canada, on purchases UNDER $50...I take the risk and go just first class. So far, haven't been burned. The only time I have been burned was my first time sending $100 worth of cards to one guy in Europe...cards not received, etc, I only sent it first class, hence, lesson learned and over $50 gets registered.
I think this is the way to do it. Sure, if someone owes you $40 for a card, and he scams you, you lose, but in the long run, I have made enough to cover those loses (but again, haven't been burned besides that 1 time, so knock on wood).
