I do not 100% agree with you on this one. There were issues with the investigation and how the police handled the case, but I believe the arrest would have happened regardless. Now, IMO, I feel the media attention brought to this case actually hurt the prosecution. They were so sure they would win because of what was going on in the media. Well, they were wrong. They did not build a strong enough case to support the murder charge. I feel the prosecution might have had a better chance of winning with no media attention, because they could have focused on building their case instead of relying on the media to do it for them.

I don't disagree with that at all. The state played a huge roll in dropping the ball and letting a guilty man walk the streets.Drug and smoke free trading.

The media's only affect on this case was that a charge was ever laid. Without the media (I am including the spokespeople for the Martin's here), this situation would have been forgotten. Once a case was brought, there simply was no evidence to support the charges. That is why charges were not filed to begin with. Sometimes the truth is hard to accept.

As I wrote somewhere else, the prosecution was watching TV when they should have been building a case. The courts of media and public opinion hold no bearing on a case and, in reality, that's the way it should be. The media, however, paints things as they aren't for their own reasons. Here in BC they split the entire province in two politically simply by calling for the leftist party to win in a landslide only to see them lose in same fashion. Why did they lose? They were overconfident and stopped campaigning 3 weeks too early, letting the province know they didn't actually give a damn.
The same thing happened here. The media called a slam dunk and the prosecution tried to take that to the bank. The check bounced, as it always does.
