Bad Ebay Seller - Maybe!

hey asujbl, why don't you go buy one of her items for over $150 and see how confident you feel about paying her. I sent my money, but if i had seen the negative feedbacks before i sent it I would not have sent it. I would not lose and ounce of sleep over it either.

And honestly, i really don't care what kind of rules Ebay or any other auction site have about paying. If i don't feel confident in paying someone, im not gonna pay. As I said before, when you buy on Ebay or any other internet site you are saying "here is my money, send my item if you feel like it."

And when it comes to someone getting enough strikes to be suspended. You don't get any strikes with me. I am getting screwed if I get scammed and they still get to sell items because they don't have enough strikes on their record.

It seems to me that the original question was bmoy88 asking for advice. My interpretation of that means he was asking for the personal opinion of everyone who reads his thread. I don't think the intention of his thread was for people to hijack his thread to argue over who has the right opinion. Why don't we just leave it at offering your personal opinion over what you would do in his situation. Now as for my personal opinion. I think you have an obligation to pay the money, but I would not do so without asking a few questions and receiving some e-mail correspondence from the seller first.

I would try to establish contact with the seller. Be upfront and tell them you are concerned about the feedback. See what kind of response you get from them and make a personal judgment call based on the quality of the communication. There may be reasonable explanations for the events of late. Just try to make good solid communication. I would ask why their PayPal account is down and when or if it will come back online. I would explain to them that you are only comfortable paying via PayPal due to recent events with their accounts.

Honesty and candor is probably the best policy here.

First off YOU DO HAVE TO PAY, if the seller wanted to they could take you to small claims court and sue you. Although for $125 they wouldn't. And just because a seller doesn't take paypal doesn't make them thieves. I no longer take paypal on most my auctions because of increased fees and problems with paypal double charging payments out of my checking account. Id email them or call them and ask why they recieved 10 negatives around the same time. I doubt they would waste there amazing feedback before this just to make a few bucks and steal the money from people. Most of the negatives were for items less than $10. Perhaps something happened to some of the cards where they got damaged and they couldn't sell them. You never know until you ask.

As for the poster of this thread: Just pay. You can't make the other person act correctly (in this case ship the card) - but you can do everything in your power to act correctly.

Get delivery confirmation and register the money order, keep all your reciepts, and then if the buyer does not send, maybe ebay will help you..idk

Ebay has a buyer protection policy in place, for this type of thing. When a seller only takes money orders, or cashiers checks, and the item cost is $25+, Ebay will refund your money, if the seller doesn't ship you the item that you paid for. Unfortunately, some sellers are aware of this, and misuse it, to their advantage, on items selling for less than $25.

Also, this is very common. CPA & Law can, (AND does), go hand-in-hand. I have talked to lawyers who were CPAs. They make a lot of $$$.
