If I'm not mistaken, only Crosby and Ovechkin Cup RCs have had actual game-used pieces on them. The backs of the cards say game used, as do the Ovechkin and Crosby shield cards from the same release. Every other Cup RC has been photoshoot.
Here is the response I got from the seller (edited for minor language):
Yes, someone just told me about it just a few minutes ago. Now i'm
really upset about this!! I bought it from "jdinohio" for $4K US in
Jan and now it looks like i'm going have to end it. Crap! Here's what
he had to say when I bought this card from him:

BECAUSE HIS OVECHKIN IS NOT A 4 COLOR LIKE MINE. I GOT THE
CARD FROM THE SAME THAT RYAN GOT THE CROSBY FROM. I
KNOW BECAUSE I WAS GOING TO BUY BOTH BUT DIDN'T HAVE THE
CASH AT THE SHOW. YOUR CROSBY WAS GRADED A BGS 9,
THOUGHT YOU MIGHT WANT TO KNOW. ON THE OVCHKIN SUBS,
PROBABLY ON THE SURFACE A 9, CENTERING A 9, CORNERS A 8.5,
AND THE EDGES AN 8.5 WITH A 10 AUTOGRAPH. ALSO I KNOW THE
PATCH ON THE CARD IS REAL BECAUSE IF IT WASN'T REAL THEN
BECKETT WOULDN'T GRADE IT. HOPE YOU KNOW THAT ME, RYAN,
AND ADAM/CHAD ARE THE 4 BEST IN THE BUSINESS AND
EVERYTHING WE SELL AND BUY IS 100% LEGIT.

Couldn't have said it better, now instead of at least having a $1500 card (ballpark) he has a card worth aprox. $0!

Too bad there is no way to "restore" the card to it's original condition.
Quick survey: (Since we already know what the original looked like) Would anyone find it more acceptable if the current owner removed the fake patch and inserted another fake patch that looked like the original?Hidden Content

How about buying a real Ovechkin game used jersey from Mei Grey and then buying a ton of his cup cards and swapping the patches. Last I checked an actual GU jersey ran close to 4500. So buy one of those, pick up a ton of one color Cup rookies which usually sell below 2000, and then make them into ridiculous patches that sell for 4,000 a piece.

How many of the 99 copies are fake? Impossible to be sure all those cards are the real thing. Impossible. The card could be modified immediately when out of the package, you scan it and put it on ebay, then a guy building a scan database of all Ovechkin put the scan in the database, and the false 4-colors Ovechkin Cup RC is now 100% legit for the hobby community! UD should do something.

Upper deck learned from this, which is why most of the truly unique patch cards get the stickers and pictures treatment from UD

Where is the UD database? If UD keep the database for them only, it is no use because people will continue to sell/trade the false Ovechkin RC on card shows and internet without knowing the authenticity of the memorabilia on the card.

I don't believe UD has a database for it's patches, why would they? Once the cards are produced and get into collectors hands it's not their responsibility. I don't blame them for not wanting to take the time, effort, and money to maintain a database for thousands of patch cards just because some people are dishonest enough to fake a handful of them. I think the only time UD scans a nice patch card is to use in promotional material, not to prove it's legitimate down the road if it happens to be questioned.
