Thanks for all the comments and advise guys.
The Buyer admitted to all of the facts above in our PayPal Dispute.
The $350 price is based on the price tag on the shoebox I sent the shoes in.
I'm hoping PayPal will recongize that Buyer is stretching her tale to make herself look innocent by falsely claiming the "items were never recieved".

Did not read all reply but I will go my my own experience and suggestion.
First, expect more and more issue with custom for one reason, Governement are always in need of money and they realise they loose ton of money from mail transaction. The era of free custom charge will disapear in time as governement are curretly taking step to crack down on these taxes lost. Canadian governement already annouce they are going after all ebay power seller. They have made a aggrement with eBay to have a list of all sales of the past five years of all power seller. They have given some time for Power seller to volontaraly declare their income and when this period is done, they will start to crack down on them with penality and interest. Just to give you a idea on how serious they are.
Now back on my own experience. On 200 transaction, I was hit twice by the custom. The first one was when I bought my Carey Price Gold the cup rookie. I had taken 1,000 $ insurance and was tax on that amount.
Second experience was a few week ago when I bought a 100$ box from blowout cards special. I had to pay 41 CAD to receive the package. In both case I paid it and left a positive feedback in the cup one.
Now most person expect to pay no tax. Even if this is ilegal, ppl still expect to not pay them, wich is wrong as this is against the law and one should expect to be hit with them. But since that was not the case, too often ppl still think they will not have to pay.
Custom will look at all 100$ plus item. Sometime we may get away with gift but again this is trying to cheat the system by lying to the custom by saying it's a gift when you actually sold something and got money in return.
Selling item over 100$ without traking number is a no no. A mistake from your part and you are learning the hard way about it. I strongly suggest the free shipping option and you calculate your shipping cost included in your final prize. This way you protect yourself. How can you trust someone you don't know when selling over 100$. Mainly if you take the chance, you also take a chance at loosing your money.
I think that as seller, we need to protect ourself on high end and not expect the buyer to protect you. I am not saying you are wrong but taking step to protect your inevestement should fall on you, not on someone you don't know. Trowing any receipt is also a no no until the 45 days period has ended. Hard lesson learned here.
Tracking number is cheap in the US compare to Canada. I still don't undertand why some don't use it. In Canada it's far more expensive and I use them all the time for high end.
You took a chance by sending a package and not protecting it. Today you might pay for it. To me it's simple. Protect yourself or take the damage if it go wrong. I choose to protect my inverstement when I trade and never had a lost in over 200 Transaction here and on ebay.
My final suggestion when selling on ebay is:
- Use tracking for all item over 50$
- Put the real value on the custom form (This way you are not lying to anyone and being straightforward)
- Print a copy of the sale from ebay and insert it inside the package.
- State this in your sale description so the buyer is aware.
- If it's a auction make sure you mention that any winning big over 99$, say you will write the sale amount on the custom form.
- Use insurance to cover your shippement for all items over 100$, (Make it mandatory in your description) and bill the buyer if he did not pay it before sending. If he refuse then place the sale in dispute because your description state it's mandatory for item over X $ and he refused
Also consider that Custom could always get back on you for false declaration and could potentially be costly to you. Not a good idea to lye to custom and have them on your back.
I know we all enjoy no tax, custom fee due to gorvenement being slow to react but I did read that both country governements have plan to counter this. Expect more and more of these type of theads in the future.

i think that sucks, having to pay 41 dollars in taxes on a 100 dollar box of cards. doesn't the government alreday tax the you know what out of you guys.

I've always believed (even as a State of New York resident) that no place in the world scams their people more on taxes than Canada. At least here in NY they're up front about reaching into your pocket... most people in Canada I've dealt with don't even know they're going to get hit with a customs fee.
Now that said... the governments do have some right to, and need to, act on internet sales, because of the sheer volume of cash they're NOT collecting anymore from local sales. Of course, true to form, they're going about it completely the wrong way.

That isn't taxes. That's a Clowns in Brown (UPS) brokerage fee.
Rule #1 above all else DO NOT use UPS if you're a canadian buying from the US. USPS offers slightly slower times but far better overall service and no brokerage fees on CDN shipments.

that sucks, but to be honest paypal is TERRIBLE. Ive lost a couple hundred dollars before because of their stupidity.

paypal is criminal in my estimation.
i had opened a dispute with a seller, followed all the procedures. paypal contacted him, he said sorry he'll send right away and then THEY ALLOWED HIM TO CLOSE THE DISPUTE. i wasnt even notified or involved in my dispute. oh yeah and guess who hasnt recieved anything still. bet you that ebay buys upper deck next.......

An update. Buyer has escalated Dispute to Claim. Guess she didn't like my tax analysis (tax should be no more than $40-50, not the peculiar amount of $125 (which is almost identical to sale/shipping price of $130).
Time to get screwed by PayPal I guess. I should've liquidated my account after every sale.

PayPal & eBay are an illegal monopoly who "double-dip" in collecting fees...on top of the fact there are way too many scam artists operating on those sites.
If the US government could force AT&T to break into multiple companies, why not them?
