Could the buyer actually do anything when he recieves the pictures instead of the cards? The buyer says in the description "picture". Can the seller claim that the buyer should have read the description and got what was offered?

I think this is a little different tho. I actually watched this on TV, and dont think it has anything to do with the cards. The sellers slip up was that she listed the weight and dimensions of the cell phone. IMO this argument can be used against the Laptop.
While I dont agree with how the sellers words anything .... he is providing no false information in his auction .... he gives you info on Crosby and Ovechkin ... which alot of people do .... and states that you are getting a picture of the cards. A scam .... you bet .... should be be kicked off ebay ... more like ill drive up the province and burn his house down
... but in all seriousness ... I think the buyer will have a few issues and alot of angry phone calls with ebay and paypal about this, with maybe not very much to show for.
On another note, when I had under 50 feedback on ebay, I sold quite a few high end cards starting at 0.99 cents. A few of the auctions were up in the $300 - $400 range, and while I had the payments from the buyers, my funds were on hold until they received them by ebay / paypal. Less than a week later, all the high end stuff was received because of Xpresspost and the funds cleared, but that might be the case here as well
