    That is a good question. The reason I didn't display it publically is because I dont know if they are a member on here or not and I don't want to scare them away before I deal with this.

    As a law school grad studying for the bar right now your friend has a definite claim for larceny by trick. In order to have larceny by trick there must be a taking of possession by intentional or knowing misstatement of fact in order to defraud. Your friend will need to contact the police and if the value was over $500 I would tell him to lawyer up as well.

    the laws are slightly different in Canada. We have Fraud under $5000, and Fraud over $5000. The value of this one is fairly low, under $25.00. the problem is the police rarely do much about it when the value is that low.

    I hate to pile on... but I have an issue with a member from QC also

    HOWEVER.... there is a reason why most US eBay sellers ask for $15+ in shipping to Canada... TRACKING

    This card was sold in early June via eBay... and if you can see, it cleared Canadian Customs TODAY! This member put in the claim on me on Tuesday and escalated it to eBay with an hour of me providing him the tracking ID.
