eBay problem please help
Here's the story, I bought a card from a seller and later got a message from him saying he was sorry but one of his employees had already sold that card it it had not been pulled from eBay yet. I was cool with that and he even offered me something else in it;s place for alot cheaper. I decided to pay a little extra and get something from him really nice because of the situation. What I decided on was a Phil Rizzuto blue sharpie 8X10 with inscription JSA certified. Now for the kicker, I just got the picture in the mail today and it was in a soft plastic sleeve that had melted to the picture during shipping. I went to pull the picture out of the cheap plastic sleeve and half of the auto and inscription stayed on the melted plastic so the picture is ruined. When I send out auto pictures I always send in hard plastic top loaders for protection and so this does not happen. I sent the guy a message about it with no response yet. I guess my question is am I stuck with a ruined picture or should I expect him to do something about it since it was mailed out cheaply ? If he automatically agrees to do something about it I'm fine. But I just want to know what I should be prepared to do if he declines to resolve the issue. What do you guys think and what would you do in mine / his position ?

If he declines to resolve it just file a complaint.

Open up a case if he doesn't help you out. And you'll most likely win and get your money back. He should give the money back, the item did not make it to your hands in the condition you bought it in. He's at fault. Its his job as the seller to package it the best he can. You have no control over how he ships it.

OK this helps alot fellas, this is the same exact thing my friend at my local hobby shop said before I got back home to read this. Still no response from the seller but I will give it a few days before I file a case to see if he will do what's right. If he says he won't do anything or never responds I will be sure to tell you guys who the seller is on the bay. Thanks for your help!

Remember that buyers have all the rights on Ebay, and they side with the buyers almost always, but give him a week to sort the matter out.

sorry to hear about that situation, that sucks, hopefully it will be resolved soon by the seller
an unrelated question but still on subject, i collect autographed 8x10s and was told the best protection for signed photos is to put them in a soft sleeve and then a hard plastic top loader. after reading this im worried about putting my photos in a soft sleeve if they are going to get melted or stuck. (that was the whole reason i put them in top sleeves) any advice? thanks

I had a probelm where a seller sent a card out cheaply and the card was damaged. I opened a case and EBAY said no one was at fault. I got my money back and was able to keep the card. Hopefully you can just get your money back.

I can tell you this, when I was a young kid I had a Joe DiMaggio 8X10 in a soft sleeve for 4-5 years because they didn't have the Ultra Pro products and things they have now. What my problem was is that I had an autograph binder with many (9) card sleeves that was heavy on top of my 8X10's in the back of the binder. Eventually I went to remove some auto pictures and the same thing happened as above to my DiMaggio and many other 8X10's I had even though my binder never left an A/C room. Hard plastic Ultra Pro top loaders are the way to go but what I do is buy them new and make sure they are blown out and clean before I put my picture in them and the pic only goes in them no soft sleeve or anything. Have not had a problem since so I hope that helps you out!
