Did she have insurance? If not, you will be paying for the damage to your car. Unless you take her to court, but if she can't afford insurance then she probably doesn't have any money to pay for your damages anyway.

My fiancee was run into the median by a semi which subsequently drove off, she hit the median, the guard rail, and part of an overpass at 70mph and she's tiny. Thank god she was in my tank of an escalade and she came out of it with only a few bruises. No airbag on that one though.
Word of advice, be thankful you are ok and maybe don't try so hard to see if you have a lawsuit? I'm glad you're ok but its just idk doesn't seem right that your main priority is a lawsuit. Get your car fixed, heal yourself up, thank whatever diety you believe in, and take it easy.

yea she has insurance, this is already in proccess of being taken care of.
her insurance will be paying for:
my car to be towed to shop, my car to be fixed, my rental car and they are saying i'm going to be getting some type of money for hitting my head on the steering wheel? she mentioned a 1st time settlement of $500 but people are telling me NOT to go that route...?

just makes me mad that i hit my head on the steering wheel! lol damn airbag should have came out or something.... or people behind me need to learn how to drive! but oh well, guess accidents happen, i just never want to be in another and i HATE the fact that my beloved car is ruined for the time being!

Due To Rules Violations
Coming from both a law enforcement perspective and having been the victim of a few accidents myself, I can say you'd have a hard time winning a suit against Toyota... Not to mention you'd most likely have an uphill battle and not see any money till you are too old to enjoy it.
Along those same lines it does appear that you got hit pretty hard, Cars are meant to take a beating, and as many have said before me accidents do happen... Was the person driving the Dodge under the influence? or just not paying attention? The laws and whats necessary to file suit against another driver vary from state to state. Point of impact or speed at which you were hit greatly influence whether airbags are deployed... For example head on collisions or T bone collisions (from the side) will deploy the airbags 99.995% of the time...However most cars don't hold airbag sensors in the rear... Its kinda buyer beware... and also why Mercedes,Lexus,Volvos are pricier... Another question I have, were you wearing a restraint system (seatbelt) at the time of impact...Again plays into things in the longrun... Glad you are seemingly okay as for your car, thats why insurance is manditory ;)

yea man i had my seatbelt on, ALWAYS put it on as soon as i get into my car. and she just wasnt paying attention i guess.

definitely a great practice. the girl i was with before my current gf never used to wear one. found out later that she got in an accident and broke her collarbone (she was a crazy driver too, not a good combo).
not to be a jerk, but she had it coming

why do you want to sue them? did you go to the hospital or have any medical bills? Seems to me that if you did you would go after the woman and her insurance company. If you sued toyota what would you sue for?
I have no clue about airbag systems, but I wouldn't think the front air bags would go off with a rear collision. not sure though.

Hey man I would take pictures of your bruised head and carefully document any doctors visits etc etc etc, you never know if you develope neck/back problems down the road. Glad you are ok though.

Very valid point raised here believe it or not adrenaline rushes after an accident can often times stay peaked for as long as 3-4 days afterwards at which time the mask is taken off and injuries begin to show themselves... The statute of limitations for most civil cases is 2 years...Meaning if you decided to file suit you'd be able to up until the 2 year anniversary of the accident date..
