I would most definitely get a full refund and leave at least a neutral feedback. Brutal standards and now a sweet card of my favorite player is destroyed!!!

I have to say I disagree with this. Under any reasonable expectation (ie. will the post office attempt to properly handle my package rather than snap it in half), a top loader would have sufficed. This is not the seller's fault in my eyes, and punishing him for someone else's mistake is not right.
Could he have protected it better? Sure! But by no means did he leave it unprotected, and therefore he is not at fault. If he is open to giving a full refund, then the seller deserves a very positive feedback for rectifying someone else's mistake.

Positive feedback all the way. The card came in a padded envelope and hard plastic. The only way the seller could have screwed up is if they did not tape up the tipoff the hard plastic or put the card in a team bag. Sure some decoys could have helped but the seller shipped properly if you ask me.

Ouch ouch ouch. That's painful to see. I had that happen to me once upon a time with a Carey Price SP Game Used RC that Canada Post curb stomped harder than Seth Rollins does to jabronis on Monday night.
I'd talk to the seller first, see if you can work out something with him, if his shipping included any type of insurance against that type of damage. Hopefully it can get resolved amicably between the two of you.

That is painful to see a 1/1 like that! I have had the 'We Care' packaging once but have seen several packages that had punctures in them.
Once had a card show up that seemed like something kinda heavy had been dropped on it with the corner piercing the envelope and hitting the Top-Loader so hard that the top-loader split in two and there was a nice dent in the card causing separation in the layering the the card. I didn't pay much so I contacted the seller and told him I would let it slide.
That having been said whenever I send a card $15+ in sales value I will use decoys on each side. Especially if I send to Europe because I know this sort of thing can happen when travelling longer distances.
I would ask for a refund but leave positive feedback. Unless the seller gives you attitude that is. If you paid a higher amount for this card then he should have shipped it with $100 Insurance.
For me I try to avoid sending with insurance unless the package is worth $75 and this is simply to save money and not having to shell out $10+ on each package. This is why I protect my cards with decoys but I also know that every now and then I will get that damaged or lost package where I have to give a refund because I didn't put Insurance on the package. Risk and reward.
Ask for a refund. Leave Positive feedback. Ask Panini if they could scrape up another (doubtful but sad to see a 1/1 off the market entirely)Master List: Hidden Content

Awww, man that blows! I feel for both parties on this one, but as a seller it is his job to get the card to you in the stated condition. While I feel he really didn't do anything wrong with the packaging, and the damage is not his fault, his chosen method of shipping the card was unsuccessful. He should still be on the hook for the refund as those are ebay's rules. That should warrant a glowing positive feedback, however. Sorry to see that!

After reading everybodys replies on what you guys think I decided to send the seller a message today. It was a short and simple message, I wasn't a jerk about it or anything and simply said it was damaged in shipping and asked if he would be open to any kind of a refund.
Hi.
I received the card yesterday (Thursday) and unfortunately it must have been damaged in shipping as it arrived with a crease straight down the middle of it on the back. I was wondering if you could offer any kind of refund.
Sorry for the inconvience.
Not hoping or expecting much but I figured this was about the only thing I could do. I also attached the pics previously shown here.

You did the right thing. The worst thing that you could have done was start accusing or blaming the seller.
I know that if someone approaches me being nice and kind I will help them out as much as I can. If they come to me and are being a jerk then it is much harder to deal with that person.
This situation happened to me a few months back. I made a trade with someone. I had shipped as I always do which is card in soft plastic, hard plastic (correct width), masking tape sealing the hard plastic, team bag, size zero padded envelope. The card that I traded was an ITG gold quad jersey /10 with a sales value of $40-50. The person who I traded the card to just sent me a message saying how their is a major crease running across the whole card that was not there in my original scan. They showed me a pic of the way that the card arrived. I double checked with my own scan of the card and came to the conclusion that the card had to be damaged in shipping. The person was really good to deal with and I had just sent him back his cards and told him to keep the damaged one. Stuff happens. If you go in being easy to deal with hopefully they will be easy to deal with too.
