Unfortunately any ebay condition such as your 72 hour statement does not apply to paypals resolution system. He will file for a damaged item through paypal and paypal will find in his favor. Paypal has a 45 day window for buyers to file regardless of what ebay lets you put in the listing. You're out the cash.

Unfortunately in my favor, neither paypal or this guy will get any physically cash for me in the next 2 weeks. I got bills and a family to worry about. Shame on me?

I just don't see how this is a problem with Ebay...isn't this something that can happen on any site? even here??? Stuff unfortunately happens but I think the positives definately outweigh the negatives...sorry to hear bout ur prob tho

everyone on ebay is either a lawyer, cop, or law expert it seems...bottom line its your fault for not insuring the package and saving your own butt...you cant rely on people being honest and by not insuring you put the trust of the other person and the post office in charge of handling it. and i personally never trust anyone i dont know with the funds in my paypal account because there are alot of slimeballs out there who will take ya for a ride if you allow them to by not insuring or using d/c...so in my opinion noone to blame here but yourself...its your responsibility to make sure the card gets to the buyer in the condition stated and sure sometimes it gets bent in transit but thats where insurance comes in and should of been gotten

crappy situation, definitely should have insured a card with that value, but hey **** happens, we've all taken risks. I can say that I have had similar situations with receiving cards in the mail (twice in the last two weeks), in a bubble mailer and just a top loader. If this is how you shipped it, then that's insufficient.
If the card is not in a rigid/magnetic/screw-down, ALWAYS at least sandwich the top loader between two cardboard pieces (decoys from busted packs work perfect). This helps ensure the card won't get dented by rogue mail, or other items during transit.
Top loaders are not very rigid/stiff and while protecting against bending (to some degree), imagine a corner of a box being wedged against the front of a card? It's going to be damaged for sure, the plastic used in top loaders isn't very thick at all. I work for a freight company as well, and we ship pallets of mail everyday, and believe me it all gets packed extremely tight.
Also, the guy has 599 100% positive feedback - all purchases, he hasn't sold anything. What that tells me is he's a collector - not likely in it to make money. Doesn't prove anything - but I'd give him/her the benefit of the doubt at least...
Anyways, just saying this type of damage isn't all that unusual if you shipped it in a top loader only (with no other protection than the bubble mailer). Imagine being on the receiving end of such a situation - it sucks both ways. Hope it all works out for you!
